Will of Elizabeth Creer – 1849 Marown

           To His Worship Thomas Arthur Corlett Esquire.
           The humble petition of Daniel Creer of 
		   Ballakelly in the parish of Marown.
Sheweth:  
     That Elizabeth Creer your petitioner's mother 
     some short time since departed this life having 
     first duly made and published her last will
     and testament whereof she appointed your 
     petitioner executor thereof.
     That your petitioner is desirous of proving 
     the said will and if being sworn executor thereof 
     in due form of law.  
           Wherefore your petitioner prays a
           hearing hereof and that your worship 
           may be pleased to received the said
           will and swear your petitioner executor 
           thereof in form of law and
           petitioner will pray.

Ordered that this petition do come on to be heard 
at a Vicars Court to be holden at Douglas on Friday the 
23d day of --- Nov next whereof all proper
parties to have due notice.

At an Eccl Court held at Douglas 23d Nov 1849.  
Upon hearing this petition in presence of the parties 
or their advocates and upon examining John Cain
and Robert Kelly the subscribing witnesses to the will 
of Elizabeth Creer deceased I am of opinion that the 
due execution of the said will by the said
testatrix has been proved and that probate ought to 
be granted as prayed for and the same is therefore 
hereby so ordered and decreed accordingly.

In the name of God Amen.
I Elizabeth Creer of Ballakelly in the parish of Marown 
(widow) being of sound and disposing mind memory and 
understanding do ordain and appoint this for my last will 
and testament as follows.
First I commit my soul to God and my body unto a decent 
Christian burial.
I leave and bequeath unto my four sons Thomas, Paul, 
John, and Edward the sum of two shillings and six pence each.  
Also unto my daughter Margaret the sum of two pounds with 
a spinnen wheel, check reel, and round table; also a
pot and kettle and bedstead with bed and bedding with 
all my wearing apparel; also a lot of flax and toe.
I leave and bequeath unto my three daughters viz Ann, Jane 
(wife of Philip Kewley and Mary (wife of William Clucas) 
the sum of ten shillings each and the sum of one shilling 
to any person claiming  anything under this will.
I leave and bequeath unto my son Daniel my half of the 
lands house and offices part of the quarterland of 
Ballakelly in the parish of Marown, now occupied and held 
by me with the remainder of my goods and effects moveable
or immoveable be the same of what nature soever with all 
my cash owing or otherwise and whom and appoint my executor 
of this my last will and testament as witness my name this 
twenty-seventh day of December 1847. Elizabeth Creer her x mark

              At an Eccl Court held at Douglas 23 Nov 1849.
John Cain and Robert Kelly the subscribing witnesses to the 
foregoing paper writing purporting to be the will of Elizabeth 
Creer deceased having made oath on the Holy Evangelist that 
the said testatrix when of sound disposing mind memory and 
understanding duly signed and executed the same in their
presence as and for her last will and testament. 
Daniel Creer the executor therein named is therefore sworn 
well and truly to fulfil and execute the same according to 
law - to pay all just debts legacies and funeral expenses
so far forth as the goods will extend and the law bind him 
and to return to the Archdeacon's Registry of this diocese a 
full true and perfect inventory of the said estate with an 
accurate account of his acts and proceedings in the premises 
when thereunto lawfully required and to these ends he has given
pledges  John Cain and Robert Kelly who have executed the usual bond in
presence of the court.       Probatum Est       T. A. Corlett.


          At an Eccl Court held in Douglas the 13th Dec 1850.
Between Robt Quilliam Plaintiff and Daniel Creer executor of 
Elizth Creer Defendant
Upon hearing this cause in presence of the parties or their 
advocates and upon reading the will of deceased it appears 
that the plaintiff is entitled thereunder to a legacy of seven 
pounds and a half of dressed flax and which has been valued at 
seven shillings and six pence. Ordered therefore that the said 
defendant do forthwith deliver up the said Flax or pay in lieu
thereof the said sum of seven shillings and six pence with 1 of 6d costs.

By the virtue of the worshipful Vicar General Corlett's 
authority that Thomas Clucas and Robert ---------- and his wife 
to appear at a court to be holden in Douglas on Friday next when 
called to answer the ---- and petition of Daniel Creer this the 
20th day of November 1849.
Thomas Christian Sumner of Marown.

Whereas the Eccl Court of this Diocese hath this day granted probate 
of the last will and testament of Elizth Creer late of Marown to 
Danl Creer the executor therein named.
And whereas John Cain of Ballamenagh in Onchan and Robt Kelly of 
the Nab in the parish of Marown have agreed to become pledges to 
the said Danl Creer for the due administration of the said Estate 
according to law. 
Therefore
know all men by these Presents, that we, the said John Caine and 
Robt Kelly Hereby bind and oblige ourselves and our Executors and 
administrators, as pledges to the said Danl Creer  for the due 
and faithful administration of the goods and effects of the said 
deceased according to law. And in his default we bind ourselves 
and our Executors and administrators to be answerable to all 
parties interested in the said Estate, or the Administration thereof.
Witness our subscriptions this 23d day of Nov 1849.

By virtue of the worshipful T. A. Corlett's authority I have charged 
William Clucas and Mary his wife and Ann Creer on this petition to 
appear at a Vicars Court to be holden at Douglas on Friday the 23d 
day of November instant when called to answer the suit and petition 
of Daniel Creer at 10 O'Clock in the forenoon this the 16 day of 
November 1849.

By virtue of the worshipfull Thos A. Corlett Esquire Vicar Generals
authority I have left charge for Paul Creer of the parish of KK Lonan being
next of kin to Elizbeth Creer deceased, to answer the suit and petition of
Daniel Creer when called upon this the 9th Nov 1849.
