Will of Daniel Creer of Marown Died 1912
THIS IS THE LAST WILL AND
TESTAMENT of me DANIEL CREER of Eyremount Terrace
Crosby in the parish of Marown Retired Farmer
I revoke all prior wills and codicils.
After payment of my just debts funeral and
testamentary expenses I leave devise and bequeath unto
my sister SARAH CREER All and Singular the
dwelling house and premises number 3 Eyremount Terrace
Crosby in the said parish of Marown and in which I no
reside ALSO all my furniture and household effects
And I declare that in the event of my said sister
SARAH CREER dying in my lifetime I direct that the said
dwelling house and furniture shall revert in the residuary
devise hereinafter contained and not of my heir (as to the
real estate)
I bequeath the following pecuniary legacies:-
To my brother in law WILLIAM KNEEN the sum of ONE
HUNDRED POUNDS (œ100) To my brother-in-law PHILIP
KNEEN the sum of TWENTY POUNDS (œ20) To my brother-
-in-law ROBERT KNEEN the sum of ONE HUNDRED POUNDS (œ100)
To my brother-in-law HENRY KNEEN the sum of FIFTY POUNDS (œ50)
To my sister-in-law MARY ANN GELLING wife of Thomas Gelling the
sum of EIGHTY POUNDS(œ80). for her sole and separate use free
from the control of her present or any future husband and her
receipt alone to be a good and sufficient discharge to my executors.
To my sister-in-law BETSY KELLY wife of Edward Kelly the sum
of ONE HUNDRED POUNDS (œ100) for her sole and separate use free
from the control of her present or any future husband and her
receipt alone to be a good and sufficient discharge to my executors.
To my sister-in-law EDITH KNEEN the sum of ONE HUNDRED POUNDS
(œ100) To my mother-in-law MARY KNEEN (Widow) the sum of
Twenty Pounds (œ20). To my cousin RICHARD CRAINE the sum
of FIFTY POUNDS (œ50) To my niece SARAH LEECE the sum
of TWENTY POUNDS(œ20) To my sister RHODDA KERMODE (Widow)
the sum of ONE HUNDRED POUNDS (œ100)
I devise all the residue of my property both real and
personal to my Executors and I direct and empower them to convert
the same into cash and further I declare that they shall then
stand possessed of the same upon the trusts following that is
to say. In the first place the shall ascertain the amount of
the loss which my estate shall sustain through the bankruptcy
of my brother JOHN FARAGHER CREER and shall set apart out of my
residuary moneys a sum equivalent to such loss and divide and
pay over the same in equal shares to my brothers and sisters viz-
EDWARD CREER, RICHARD CREER, CATHERINE CALLISTER wife of JOSEPH
CALLISTER, and RHODA KERMODE. And in the second place
as to the balance of such residuary money then remaining my
Executors shall divide the same into FIVE EQUAL SHARES and as
to one such share shall pay over the same to my said brother
EDWARD CREER and as to another such share shall pay over the
same to my said brother RICHARD CREER and as to another such
share shall pay over the same to my sister CARTHERINE CALLISTER
wife of Joseph Callister, and as to another such share shall
pay over the same to my sister RHODA KERMODE and as to the
remaining share thereof I declare that my Executors shall
stand possessed thereof and of the accumulations (if any) of
the income thereof IN TRUST for such of the children of my
said brother JOHN FARAGHER CREER as shall be living at the time
of my decease and attain the age of twenty one years in equal
shares as tenants in common And I further declare that
during the minority of any of the said children my Executors
may in their uncontrolled discretion apply the whole or such
part as to them may seem fir of the income or corpus of such
trusts funds not exceeding in the case of any one child the
presumptive or expectant share of such child for or towards
the maintenance clothing support education and advancement in
life of any of the said children of my said brother John
Faragher Creer and for such purposes my executors may either
themselves pay the money of the see fit pay the same over to
the Guardians of such child or any persons or person having
the active care and custody of such child without being in
any case bound to see to the application of such funds.
And I further declare that should either of my
said brothers EDWARD CREER, and RICHARD CREER, and my said
sisters CATHERINE CALLISTER and RHODA KERMODE die in my lifetime
leaving issue any of whom shall be living at my death shall
take equally amongst them if more than one the share which
their respective parents would have taken if living at my death.
I nominate constitute and appoint my said brother RICHARD
CREER and my brother-in-law JOSEPH CALLISTER as EXECUTORS
of this my will.
AS WITNESS my name this Sixteenth day of July one
thousand nine hundred and four (1904)

cross mark, the same having first his X mark
been read over to him, in the
presence of us, present at the
same time, who at his request, in
presence of each other, have

The humble petition of Richard Creer and Joseph Callister
Sheweth :-
1. Daniel Creer late of Eyremount
Terrace Crosby departed this life on or
about the 7th January 1912 leaving
a will dated the 16th July 1904 whereof
he appointed your petitioners executors
2.It is necessary that probate of the
said will should be granted
Wherefore your petitioners humbly
pray a hearing hereof and
that Your Honour may be
pleased to grant probate of
the said will to your petitioners
with such this relief as a ?????
